We just sent out the latest edition of Compliance Watch – Legion’s quarterly bulletin about key changes in compliance rules. It includes information and resource links to help you monitor new employment laws and make managing and maintaining compliance easier.

This edition covers recent and planned updates to CA Fast Food Council and Fair Workweek Laws.

CA Fast Food Council

On January 17, 2023, a California court issued a ruling delaying the effective date of the California Fast Food Accountability and Standards Recovery Act (“Act”). Over 1 million signatures were collected to put a referendum on the ballot in November 2024 to overturn the Act.

Fair Workweek Law Updates

Many cities and states have existing Fair Workweek laws, such as NYC, San Francisco, Seattle, Philadelphia, Chicago, and Oregon.

On April 1, 2023, the City of Los Angeles Fair Workweek Ordinance takes effect; this ordinance applies to retail businesses in Los Angeles that have at least 300 employees globally. Employers will be required to pay premiums for scheduling changes during the advance notice period, clopening violations, and must send good faith estimates to new hires, among other things.

On December 13, 2022, the City of Berkeley, California, passed a Fair Workweek Ordinance that will take effect in January 2024. The law applies to (a) retail, hotel, manufacturing, building services, healthcare, or warehouse services employers with at least 10 employees in Berkeley and 56 or more employees globally; (b) restaurants with at least 10 employees in Berkeley and 100 or more employees globally; (c) retail and restaurant franchisees with at least 10 employees in Berkeley and 100 or more employees in the franchise globally; and (d) non-profit organizations with at least 10 employees in Berkeley and 100 or more employees globally. Similar to Los Angeles, employees are owed premiums for schedule edits during the advance notice window, clopening violations, and are owed good faith estimates upon hire.
